General Terms and Conditions

1. Scope

These GTC apply to all orders placed through our online shop.

2. Contracting Parties, Conclusion of Contract

The purchase contract is concluded with WWS METALLFORMEN GMBH.

By listing products in the online shop, we make a binding offer to conclude a contract for these items. You may place items non-bindingly in your shopping cart and correct your entries at any time before submitting your binding order using the correction tools provided and explained during the ordering process. The contract is formed when you accept the offer for the goods in your cart by clicking the order button. You will receive an email confirmation immediately after order submission.

3. Contract Language, Contract Text Storage

The available languages for contract conclusion are German and English.

We store the contract text and will email you the order details and our GTC. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Terms

Shipping costs apply in addition to the stated product prices. Details about shipping costs are provided with the offers.

We only deliver via shipping. Self-collection of goods is unfortunately not possible.

4.1 Partial Cancellation

If partial cancellation reduces the order value below the €50 free shipping threshold, the conditions for free delivery within Germany no longer apply. Shipping costs may therefore be charged subsequently.

5. Payment

Our shop generally offers the following payment methods:

PayPal Plus
Through PayPal Plus payment service, we offer various PayPal payment methods. You will be redirected to PayPal's website where you can enter payment details and confirm the payment instruction to PayPal.

When choosing PayPal, you must be registered (or register) and authenticate with your credentials to pay. The transaction is processed automatically by PayPal immediately after payment confirmation. Further details during checkout.

When choosing credit card payment, no PayPal account is required. Your card will be charged immediately after payment confirmation and authentication as legitimate cardholder. Further details during checkout.

When choosing direct debit, no PayPal account is required. By confirming payment, you authorize PayPal to debit your account (prenotification will be sent). Your account will be debited after payment initiation. Further details during checkout.

6. Retention of Title

Goods remain our property until full payment is received.

7. Transport Damage

For goods with obvious transport damage, please report defects immediately to the delivery agent and contact us without delay. Failure to report won't affect your statutory rights, but helps us pursue claims against carriers/insurers.

8. Warranty and Guarantees

Unless otherwise agreed below, statutory warranty rights apply.
For used items, the limitation period for defects is one year from delivery.
These limitations don't apply to claims arising from:

  • Personal injury or death
  • Intentional or grossly negligent breaches
  • Fraudulent misrepresentation
  • Breach of fundamental contractual obligations (cardinal duties)
  • Express guarantees
  • Product liability claims

9. Liability

We have unlimited liability for:

  • Personal injury or death
  • Intentional or grossly negligent breaches
  • Express guarantees
  • Product liability claims

For negligent breach of cardinal duties, liability is limited to foreseeable damages typical for the contract. Other damage claims are excluded.

10. Dispute Resolution

The European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/. Consumers may use this platform to resolve disputes.

For disputes arising from consumer contracts, we're obligated to participate in proceedings before the consumer arbitration board of the Center for Dispute Resolution, Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in proceedings before this body.
